Terms of Service

These Terms of Service ("Terms") govern your use of all Pemystack products and services, including software applications, developer tools, APIs, and related services (collectively, the "Service"), operated by Pemystack ("we", "us", "our").

By using any Pemystack product, you agree to these Terms. If you do not agree, do not use the Service.

1. Service description

Pemystack builds software products spanning developer tools, legal technology, education management, productivity, and outreach automation. Products may use AI for analysis and generation, either via our own integration or a BYOK (bring your own key) model where you provide your own AI API key.

2. Account and access

  • Access is granted through the authentication method provided by each product (Google, GitHub, email, or other).
  • You are responsible for maintaining the security of your account and any credentials you provide.
  • You must be at least 18 years old or have the legal capacity to enter into these Terms.

3. Plans and billing

  • Where applicable, paid plans are billed through the platform indicated in the product (GitHub Marketplace, M-Pesa, or other).
  • Plan features and limits are as described at the time of purchase.
  • We reserve the right to change pricing with 30 days' notice for existing subscribers.
  • Cancellation follows the billing platform's process. You retain access until the end of your billing period.

4. Your data

  • Your content remains your property. We claim no ownership over data you provide.
  • We process your data only to provide the service you requested.
  • We do not use your content to train AI models.

5. AI features

  • Some products use AI for analysis and content generation. AI outputs are provided as-is and may contain errors.
  • Where BYOK applies, you are responsible for costs with your AI provider and must comply with their terms.
  • We do not store BYOK API keys beyond the duration of each request.

6. Acceptable use

You agree not to:

  • Circumvent usage limits or plan restrictions
  • Use the Service to process data you do not have the right to use
  • Reverse-engineer or attempt to extract the source code of proprietary components
  • Use the Service for any unlawful purpose

7. Availability and support

  • We aim for high availability but do not guarantee uptime. The Service is provided "as is".
  • Support is available via email and product-specific channels.
  • We may modify, suspend, or discontinue features with reasonable notice.

8. Limitation of liability

To the maximum extent permitted by applicable law, Pemystack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that AI analysis results are complete, accurate, or free from errors.

10. Intellectual property

  • Your code remains your property. We claim no ownership over your source code or repositories.
  • The Pemystack name, logo, and Service code are our intellectual property.
  • The free GitHub Actions (regressor-action, greenlight-action) are open source under their respective licenses.

11. Termination

  • You may cancel your subscription at any time through GitHub Marketplace.
  • We may suspend or terminate access for violation of these Terms, with notice where practicable.
  • Upon termination, your usage data will be deleted within 30 days.

12. Governing law

These Terms are governed by the laws of Kenya. For EU users, nothing in these Terms limits your rights under the GDPR or other mandatory consumer protection laws of your jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via the GitHub Marketplace listing or email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
